Get Started with Gusto →Maryland-Virginia Tax Reciprocity Explained
If you live in Virginia and work in Maryland, you can take advantage of a tax reciprocity agreement between the two states. This means you only have to pay income tax to your home state (Virginia) and are exempt from Maryland state and local county income taxes.
How to Claim the Exemption
To stop Maryland taxes from being withheld from your paycheck, you must file Form VA-4 with your employer. Once filed, your employer should stop withholding Maryland taxes. If you fail to file this form, your employer is required to withhold Maryland taxes, and you will have to wait until you file your Virginia tax return to claim a credit for the taxes paid to Maryland.
